Civil Aviation Security – Public Interest Law Association of Pakistan v. Federation of Pakistan and others

In the aftermath of the tragic plane crash that occurred on a Karachi-bound flight originating in Lahore in May, 2020, PILAP filed a Writ Petition before the Sindh High Court against the Federal Government through the Aviation Division; Pakistan International Airlines; the Civil Aviation Authority; Airbus; the Pakistan Airline Pilots Association and GE Capital Aviation Services. The Writ Petition was filed given the large number of airplane accidents that have occurred over the years due, in large part, to regulatory failures, resulting in loss of lives and property damages. The Petition asks for a judicial commission to be set up in order to inquire into the mismanagement of the national flag carrier. Other relief sought includes revision of air accident compensation laws to bring them into conformity with the Montreal Convention for Unification of Certain Rules for International Carriage by Air, 1999 so that victims receive fair compensation. The petition has been allowed by the Honourable High Court.
